The Constitution was written -- largely by James Madison -- to define and to limit the federal government, and it was quickly amended by adding the Bill of Rights so as to be sure that natural rights would be respected by the government.
This tension between the power of the majority -- at the ballot box or in Congress -- and the rights of the minority -- whether a discrete class of persons or a minority of one -- is known as the Madison dilemma. Stated differently, the Constitution provides for protection against the tyranny of the majority.
In our system, the power to resolve the dilemma is reposed into the hands of the judiciary, and those who have that power are to resolve it without regard to popularity or politics. Their oath is to the Constitution. They have the final say on what the laws mean. If they follow the Rule of Law, they will invalidate that which the government has done and which is properly challenged before them and which is not authorized by the Constitution. Their very purpose is to be anti- democratic, lest the popular majority takes whatever lives, liberties or property it covets. In return for life tenure, we expect judicial modesty, and we demand constitutional fidelity -- not political compromise.

In our era, the violations of the Rule of Law have become most troublesome when the government breaks its own laws. Prosecute Roger Clemens for lying to Congress? What about all the lies Congress tells? Prosecute John Edwards for cheating? What about all the cheating in Congress when it enacts laws it hasn't read? Bring the troops home from the Middle East? What about all the innocents killed secretly by the president using CIA drones? Can't find a way to justify 'Obamacare' under the Constitution? Why not call it what its proponents insisted it isn't -- a tax?

We live in perilous times. The president acts above the Rule of Law and fights his own wars. Congress acts below the Rule of Law by letting the president do whatever he can get away with. And this summer, the Supreme Court rewrote the Rule of Law.

The Food Stamp Program, administered by the U.S. Department of Agriculture, is proud to be distributing the greatest amount of free meals and food stamps ever.

Meanwhile, the National Park Service, administered by the U.S. Department of the Interior, asks us to "Please Do Not Feed the Animals."
Their stated reason for the policy is because the animals will grow dependent on handouts and will not learn to take care of themselves.

As the Baltimore Sun's TV critic, David Zurawik, wrote: "So, why put it out there in the first place, if you don't have it nailed down?"
While blaming ABC News and Brian Ross for besmirching reputations and irresponsible reporting, Mr. Zurawik doesn't answer his question.

Dear Editor

What has become of our fourth estate?

On July 14, 2012 there was an article by Mark Scolforo and Maryclaire Dale, and it was captioned; "Joe Paterno would have faced many charges". It asserted that Paterno did not tell the full truth to the grand jury and that he also attempted to avoid or conceal what would be bad publicity for the Pennsylvania State University. Reference is also made in the article, to the Philadelphia priest who was convicted of child endangerment for his handling of assignment of other priests that were accused of sexual abuse. These findings should raise consciences of all citizens regarding our actions and attitudes concerning what we should do with regard to the truth. The full truth is a must so long as it is factual. This does not mean that we should spread rumor or innuendo.

The press is sometimes referred to as the ‘Fourth Estate’. The expression means that the printed and electronic press has the duty, under freedom of the press, to stand between the two major political parties. The full and accurate truth is their responsibility. This should apply to their exercising of the vetting process of political candidates at all levels. This means that members of the third estate should and must present and expose the full and accurate truth and not shade their reporting because of their allegiances or persuasions.

The past performances of the press with regard to the vetting of Barack Obama, in my opinion, were tantamount to criminal, if not just plain dereliction of duty. The short comings of the press in the reporting of President Obama’s associations, experience, and connections, left many with a party’s endorsement of the less than qualified. The press coverage was omissions by intent.


Barack Obama has openly refused to enforce or changed laws regarding immigration, and the Defense of Marriage Act. His Attorney General refused to prosecute the Black Panther voter intimidation incident which occurred in Philadelphia, claimed a “slam dunk" by experts. His Health and Human Services Secretary has removed the work requirement from the Welfare law. At inauguration the presidents swear to uphold and defend the laws of the United States. It is not the power of one branch of government to waive portions of laws. The press’ quiet mentioning of these actions is not producing the full truth. Very few of the press ever explained Obama’s association with characters of concern, such as Tony Rezco, or George Soros. Like 2008 everything questionable tends to be overlooked or down played.  Where is the full truth? Many in the ‘Third Estate’ have become the mouth piece of silence with regard to facts. Silence is the same as a lie when the full truth is ignored.

Taxes in Obama Care

One of the tenants of the Tea Party is lower or control of taxes.

Much has been said concerning Obama Care.

As excerpted from the Investor’s Business Daily the following are Tax hikes, which cost some $675 billion over the next decade, include:

• A 2.3% excise tax on U.S. sales of medical devices that's already devastating the medical supply industry and its workforce. The levy is a $20 billion blow to an industry that employs roughly 400,000.

Several major manufacturers have been roiled, including: Michigan-based Stryker Corp., which blames the tax for 1,000 layoffs; Indiana-based Zimmer Corp., which cites the tax in laying off 450 and taking a $50 million charge against earnings; Indiana-based Cook Medical Inc., which has scrubbed plans to open a U.S. factory; Minnesota-based Medtronic Inc., which expects an annual charge against earnings of $175 million, and Boston Scientific Corp., which has opted to open plants in tax-friendlier Ireland and China to help offset a $100 million charge against earnings.

• A $24 billion tax on the paper industry to control a pollutant known as black liquor.

• A $2.3 billion-a-year tax on drug companies.

• A 10% excise tax on indoor tanning salons.

• A hike in the threshold for writing off medical expenses to 10% of adjusted gross income from 7.5%.

• A new cap on flexible spending accounts of $2,500 a year.

• Elimination of the tax deduction for employer-provided prescription drug coverage for Medicare recipients.

• An income surtax of 1% of adjusted gross income, rising to 2.5% by 2016, on individuals who refuse to go along with Obama Care by buying a policy not OK'd by the government.

• A $2,000 tax charged to employers with 50 or more workers for every full-time worker not offered health coverage.

• A $60 billion tax on health insurers.

• A 40% excise tax on so-called Cadillac, or higher cost, health insurance plans.

All told, there are 21 new or higher taxes imposed by Obama's health care law — and 21 more reasons to repeal it.

 Barack Hussein Obama is no fool. He is not incompetent. To the contrary, he is brilliant. He knows exactly what he’s doing. He is purposely overwhelming the U.S. Economy to create systemic failure, economic crisis and social chaos – thereby destroying capitalism and our country from within.

 Barack Hussein Obama was my college classmate.

( Columbia University , class of '83).

 He is a devout Muslim; do not be fooled. Look at his Czars.... Anti-business…anti-American. As Glenn Beck correctly predicted from day one, Barack Hussien Obama is following the plan of Cloward & Piven, two professors at Columbia University ... They outlined a plan to socialize America by overwhelming the system with government spending and entitlement demands.

Add up the clues below. Taken individually they're alarming. Taken as a whole, it is a brilliant, Machiavellian game plan to turn the United States into a socialist/Marxist state with a permanent majority that desperately needs government for survival... And can be counted on to always vote for even bigger government.

Why not? They have no responsibility to pay for it.

Universal health care!

The health care bill had very little to do with health care. It had everything to do with unionizing millions of hospital and health care workers, as well as adding 15,000 to 20,000 new IRS agents (who will join government employee unions).

Obama doesn’t care that giving free health care to 30 million Americans will add trillions to the national debt. What he does care about is that it cements the dependence of those 30 million voters to Democrats and big government. Who but a socialist revolutionary would pass this reckless spending bill in the middle of a depression?

Cap and trade!

Like health care legislation having nothing to do with healthcare, cap and trade has nothing to do with global warming.  It has everything to do with redistribution of income, government control of the economy and a criminal payoff to Obama’s biggest contributors. Those powerful and wealthy unions and contributors (like GE, which owns NBC, MSNBC and CNBC) can then be counted on to support everything Obama wants. They will kick-back hundreds of millions of dollars in contributions to Obama and the Democratic Party to keep them in power. The bonus is that all the new taxes on Americans with bigger cars, bigger homes and businesses helps Obama “spread the wealth around.”

Make Puerto Rico a state.  Why?

Who’s asking for a 51st state?  Who’s asking for millions of new welfare recipients and government entitlement addicts in the middle of a depression? Certainly not American taxpayers!  But this has been Barack Hussien Obama’s plan all along. His goal is to add two new Democrat senators, five Democrat congressmen and a million loyal Democratic voters who are dependent on big government.

(This will tip the balance of those living off the government to more than those who must pay for it; and we’re done for)

Legalize 12 million illegal Mexican immigrants.

Just giving these 12 million potential new citizens free health care alone could overwhelm the system and bankrupt America . But it adds 12 million reliable new Democrat voters who can be counted on to support big government. Add another few trillion dollars in welfare, aid to dependent children, food stamps, free medical, education, tax credits for the poor, and eventually Social Security...

Stimulus and bailouts.  Where did all that money go?

It went to Democrat contributors, organizations (ACORN), and unions -- including billions of dollars to save or create jobs of government employees across the country.

It went to save GM and Chrysler so that their employees could keep paying union dues.

It went to AIG so that Goldman Sachs could be bailed out (after giving Obama almost $1 million in contributions).

A staggering $125 billion went to teachers (thereby protecting their union dues).

All those public employees will vote loyally Democrat to protect their bloated salaries and pensions that are bankrupting America ...The country goes broke, future generations face a bleak future, but Obama, the Democrat Party, government, and the unions grow more powerful.

The ends justify the means.

Raise taxes on small business owners, high-income earners, and job creators.  Put the entire burden on only the top 20 percent of taxpayers, redistribute the income, punish success, and reward those who did nothing to deserve it (except vote for Obama).

Reagan wanted to dramatically cut taxes in order to starve the government.Barack Obama wants to dramatically raise taxes to starve his political opposition.

With the acts outlined above, Barack Hussein Obama and his regime have created a vast and rapidly expanding constituency of voters dependent on big government; a vast privileged class of public employees who work for big government; and a government dedicated to destroying capitalism and installing themselves as socialist rulers by overwhelming the system.

 Add it up and you’ve got the perfect Marxist scheme – all devised by my Columbia University college classmate Barack Hussein Obama using the Cloward and Piven Plan...

10. State senate papers. In the 2008 primary, Obama criticized Hillary Clinton for not releasing papers from her eight years as First Lady--but failed to produce any papers from his eight years in Springfield. “They could have been thrown out,” he said.

9. Academic transcripts. His supposed academic brilliance was a major selling point, but Obama (by his own admission) was a mediocre student. His GPA at Occidental was a B-plus at best, and his entering class at Columbia was weak. Can he prove his merit?

8. Book proposal. Obama’s literary agent claimed he was “born in Kenya”--for sixteen years. His original book proposal exists--biographer David Maraniss refers to it--and seems to have embellished other key details of his life. Yet it has never been released.

7. Medical records. In 2000, and again (briefly) in 2008, GOP presidential candidate Sen. John McCain released thousands of pages of his medical records. Obama, who had abused drugs and continued smoking, merely provided a one-page doctor’s note.

6. Small-dollar donors. In 2008, the McCain campaign released the names of donors who had contributed less than $200, though it was not required to do so. But the Obama campaign refused, amidst accusations it had accepted illegal foreign contributions.

5. The Khalidi tape. In 2003, Obama attended a party for his good friend, the radical Palestinian academic Rashid Khalidi. The event featured incendiary anti-Israel rhetoric. The LA Times broke the story, but has refused to release the tape--and so has Obama.

4. The real White House guest list. Touting its transparency, the Obama White House released its guest logs--but kept many visits secret, and moved meetings with lobbyists off-site. It also refused to confirm the identities of visitors like Bertha Lewis of ACORN.

3. Countless FOIA requests. The Obama administration has been described as “the worst” ever in complying with Freedom of Information Act requests for documents. It has also punished whistleblowers like David Walpin, who exposed cronyism in Americorps.

2. Health reform negotiations. Candidate Obama promised that health care reform negotiations would be televised on C-SPAN. Instead, there were back-room deals worth millions with lobbyists and legislators--the details of which are only beginning to emerge.

1. Fast and Furious documents. After months of stonewalling Congress, Attorney General Eric Holder asked President Obama to use executive privilege to conceal thousands of documents related to the deadly scandal--and Obama did just that.

In addition to the above, Obama and his campaign have lied about many facts about his past--his membership in the New Party; his extensive connections with ACORN; and his continued relationship with domestic terrorist Bill Ayers and Jeremiah Wright, among other examples. Obama’s own memoir is filled with fabrications. And now he is lying about his opponent’s honorable record in business. He--and the media--have no shame.

    The confusing, convoluted decision by the U.S. Supreme Court to uphold President Barack Obama the Affordable Care Act is apropos to the most stupid piece of legislation ever passed,“Obamacare.” Chapters could be written on this law’s irrationality, but suffice it to say that adding 30 million more people to an existing health care system without providing for additional doctors or facilities is stupid. But what can you expect from an administration that:
— On its first day orders the Guantanamo detainee site closed, but has no plan for where to hold the terrorists or where to try them.
 — Takes nine days to realize the seriousness of the BP oil spill in the Gulf and then refuses help from the world’s best clean-up equipment and crew.
 — Takes 17 days to partially respond to Louisiana’s request to fill-in breaks in barrier islands. In the meantime, oil from the spill inundates pelican breeding grounds.
— Berates BP for economic damage but, ignoring a federal court order, shuts down oil platforms, putting businesses and 40,000 people out of work.
— Wastes hundreds of billions of our children’s money on a stimulus that failed to reduce unemployment but, turns down the Keystone pipeline, which would have furnished hundreds of thousands of jobs with private investment. And the serial stupidity goes on and on.


Not that our inexperienced president is unintelligent. Lord Bertrand Russell said, “Men are born ignorant, not stupid. They are made stupid by education.”


 And so we see that President Barack Obama was born to a socialist mother, raised by socialist grandparents, mentored by an open communist and guided through maturity by leftist radicals. You see, this egocentric narcissist has no way of knowing anything better than stupid, retrogressive Marxist ideology. To him, government distribution of wealth and health care are means of control, which always result in less of each.
